Ans: That honourable Supreme Court held in UNION OF INDIA AND OTHERS V. SUJATHA VEDACHALAM (SMT) AND ANOTHER, 2000 that an excess amount paid by mistake will be recovered and would be refunded. 
Thus, the respondent has the right to recoup the loss by recovering the amount of Rs 4,44,271 from the petitioner.
