That the honourable Supreme court has manifestly held in chandni prasad uniyal and others v. State of Uttarakhand and others, 2012 that an excess amount paid by mistake will be recovered. Thus, the respondent has the right to recover the amount of Rs 4, 44, 271 from the claimant and claimant is bound to refund the amount of Rs 4, 44,271 to respondent.
